This privacy and security policy (the “Policy”) explains the information we collect about you, how and why we use the information, and what security steps are taken to protect the information. This Policy is part of the Terms & Conditions of Use that govern the Website and is binding on all Website users. What information do we collect and how do we use it?

Papayaart.com collects information from our customers in an effort to improve their shopping experience and to communicate about products, services, and promotions. We collect information such as name, telephone number, email, postal address, and payment information (“Personal Information”) that you provide to us when you register an account on our site, place an order, participate in a sweepstakes, promotion or survey, or create product collections, wish lists, and other user-generated content. We may use this information collected online to process and fulfill your order. We also collect email addresses at various site locations in order to send you necessary order-related messages such as order confirmation and shipment confirmation notices. We also monitor site use and traffic patterns to improve our web site design and the products and services we offer. Papayaart.com recognizes that it must maintain and use Personal Information responsibly.

 

Disclosure of Information

PAPAYA! will not rent or sell your personal information for any reason. We may disclose information about you to other members of the PAPAYA! corporate family and as required by law. We do not share credit card or other payment information with third parties except for the purposes of processing payment for products and services you’ve ordered and as required by law. In addition, we may disclose credit card and other information we collect from you with an outside company with which we have contracted for their services to protect against fraud and the unauthorized use of credit and gift cards.

 

Secure Shopping

Orders placed on the Website are encrypted using 128-bit secure sockets layer (SSL) technology, so you can rest assured that your transactions are protected. With SSL implemented on both the client and server, information sent via the Internet can be trusted to arrive privately and unaltered to our server. In order for TLS/SSL security to work, you must use an SSL enabled browser. Please note that e-mail is not encrypted and is not considered a secure means of transmitting credit card numbers. We will never ask for sensitive Personal Information via e-mail.

Direct Selling Agreement

PAPAYA! only authorizes our wholesale customers to sell our products directly through retail channels. We do not authorize the sale, or re-sale, of PAPAYA! or Leelah products through third-party websites. Third-party websites are defined as any website not belonging directly to the company that is agreeing to these Terms of Use for authorized wholesale accounts. Any company found selling PAPAYA! or Leelah products through a third-party website may be subject to penalty of law and PAPAYA! maintains the right to immediately and permanently terminate or suspend a business relationship with any company, or person, selling PAPAYA! or Leelah products through a third-party website, or allows any other party to do so.

 

Orders

Minimum amount for an opening order is $200; for re-orders, the minimum is $100. Back-orders under $50.00 will be automatically canceled. Please contact us with special requests regarding back-orders. All products must be ordered in minimum quantities where listed. All orders will be rounded to the nearest minimum quantity. Orders may be placed via phone (888-488-0638 ext. 1), fax (877-772-7292), e-mail (orders@papayaart.com), or create a wholesale account online to place orders through our website. Office hours are Monday through Friday: 9am – 5pm PST.

PAPAYA! Does not offer territorial or product exclusivity in the United States or Canada.

 

Payment

Payment is by credit card, check, wire, and pre-approved Net 30. We accept credit card payments with Visa, MasterCard, American Express, and Discover. A $30 fee will be charged for returned checks. Opening orders are required to be paid via credit card or check in advance. The first order for all new accounts must be paid in full; otherwise, no other orders will be released for shipment. Your first three orders must be paid via credit card or check in advance. After your first 3 orders, you may apply for Net 30 terms. Please see “Terms” section below for details.

 

International Customers

International customers are responsible for entry into destination country, including: freight forwarding arrangements, customs clearance and all associated broker charges, import duties, customs, fees, tariffs, and taxes. Shipping and other fees for orders denied by customs or refused by the customer will not be refunded. Refunds for product will be made once the product is received back at our facility; re-stocking fee may apply. All new Papaya, Inc. international customers must have a freight forwarding company with a ship to address within the United States in order to receive Papaya, Inc. shipments. All costs charged by your freight forwarder are your responsibility. Papaya, Inc. does not offer terms on International orders. International orders are defined as shipments outside of the 50 U.S. states. Where we have international distributors, all orders must be made through our distribution partner and not through Papaya, Inc. directly.

 

Terms

Customers can apply for Net 30 terms if they have been in business by the current owner for at least one year and have completed at least 3 orders via credit card or check in advance. You must provide company financial information, at least 4 current credit references with valid fax number, and any other information we may request before being considered for terms. Please note: it can take up to 3 weeks to process your application once all information has been received. If credit is approved, terms are net 30 days from date of invoice. No discount is offered for early payment. Net 30 accounts will be charged a 3.5% processing fee for credit card payments. Papaya, Inc. does not offer terms on International orders. International orders are defined as shipments outside the 50 U.S. states.

 

Shipping

All Papaya, Inc. products are FOB Medford, OR. Shipments will be delivered by UPS to the contiguous US states; USPS to Hawaii, Alaska, and Canada. Special handling or shipping instructions must be specified and confirmed in advance, and may be subject to extra charges. Your account can be set to accept or cancel backorders, let us know what you prefer. If you do not specify a preference, you will receive a backorder when at least $50 worth of product on original order is out of stock.

 

Claims and Returns

Papaya, Inc. does not accept returns unless the product is damaged, defective, or an error was made by Papaya, Inc. If it is our error, or the product is defective, we will send a correction free of charge, but may request the item be returned in advance, if deemed necessary. All sales are considered final. Any claims for shortages, damages, or defective merchandise must be made within 15 business days of invoice by contacting Patty at 1-800-488-0638 ext. 302 or pattyb@papayaart.com. If your return is approved, Patty will issue a return merchandise authorization (“RMA”) number. Please return the product with the RMA number clearly marked on the outside of the packaging. A credit to the customer account will be issued upon receipt of the returned product only if the RMA number is clearly marked on the outside of the packaging. Product must be unused and in original packaging without price tags for returns to be accepted. Return of goods requires prior approval from Papaya, Inc. Any returns sent without prior approval and a RMA number will be refused.
